Here is the minutes provided by the Commission:

Upon motion made in public session, Chairman Yospin called for adjournment of the Public Session into closed session to discuss the following items:

1. Discussion of the format and internal administration of the Commission’s Involuntary Discharge Packet. General Provisions Article, § 3-103(a)(1)(i)

2. Consult with the Deputy Principal Counsel Deborah Donoghue, AAG- Presentation on the Impact of the North Carolina Supreme Court Decision on Board/Commission Members, and Its Rulings.

General Provisions Article, § 3-305(b)(8)

The Closed Session was called to order at 3:45 p.m. and held under the authority of § 3-103 of the General Provisions Article.

In attendance, in addition to Chairman Yospin, were Commissioners Berliner, Costa, Hanes, Leon, Segal, Thavajah, and Wise were present.

In attendance representing Staff was Eva Schwartz, Executive Director and Donna Adcock, RN, Surveyor.

Also attending was Adam Malizio, Commission Counsel.

Item One

The Commission reviewed the current Involuntary Discharge Packet and approved the packet for Commission Involuntary Discharge documentation. The Commission will include 2 Commissioners and the Chairman for review of each involuntary discharge request. The Commission will attempt to obtain a statement from the patient being discharged and Commissioners reviewing the discharge packet will supply a brief note regarding their findings to support their decision for the disposition o the complaint.

Item Two Deputy Principal Counsel Deborah Donoghue presented the Office of Administrative Hearing Antitrust Review and discussed the impact for the Commission(ers).

Upon Motion made, the Closed Session was adjourned at 5:21 p.m.
