COMPTROLLER OF MARYLAND: Statement from Comptroller Peter Franchot on the South Dakota v. Wayfair decision

Comptroller of Maryland issued the following announcement on June 22.

"I'm exceedingly pleased with the Supreme Court's majority decision in the South Dakota v. Wayfair case. In this age of e-commerce, the current federal law - as established in the 1992 Quill v. North Dakota ruling - is fundamentally outdated and unfair. It effectively penalizes "bricks-and-mortar" businesses that choose to locate, hire employees and invest in the State of Maryland.

It is in that spirit that I've been a leader among states in urging Congress to adopt the Marketplace Fairness Act, which would have obligated retailers who sell their products online, and through catalogues, to collect and remit the same sales taxes as our local stores. It is in that same spirit that we were one of 40 states that asked the Supreme Court to overturn the Quill decision.

My Office is now in the process of reviewing the details of the Supreme Court's decision, and we will be communicating with businesses and taxpayers as quickly as possible with information regarding implementation and compliance with the Court's guidance."
